I'm finally ready to get my authority. I'm going to use OOIDA for the paperwork. They say that "Many brokers will not load on a common carrier."

I will be starting out running anything and everything and I'm sure I'll need to use brokers.

I thought the way to go is "common" based on other hotshot's posts. She recommends that I sign up "contract" if I want to use brokers and load boards...which I do.

And If I'm fortunate enough to get a real contract with a shipper does it really matter what I'm classified as? She also mentioned that they might be doing away with this in 07.

How are you folks set up?

I am set up as common carrier. If you look at the definition you have no choice that I see. Go to the FMCSA website to the handbook and look at the definitions. Contract carriers do not have to carry cargo insurance and common carriers do. A contract carrier means you have a contract with a company to carry their product specifically and only.

Hey guys you are contract carriers if you use bill of ladings. That is a contract. I spoke with the AL dot about this question several years ago and he said now a days it is null in void. He said "common" was around a long time ago but not seen anymore. He said that they don't care either way but he said that a bol is a contract!

Nobody wants to do the research themselves but want someone to give it to them. Here it is right out the the same place you can get it. It took less than a minute to find it.

Common Carrier: Before January 1, 1996, this was a company that provided for-hire truck transportation to the general public. The services offered and the prices charged were published in a public tariff and these were the only prices the common carrier could charge.

Contract Carrier: Before January 1, 1996, this was a company that provided for-hire truck transportation to specific, individual shippers based upon private contracts between the carrier and each shipper, stipulating the services offered and the prices charged to each.

Selecting "Common" or "Contract": The OP-1 form requires an applicant to designate whether it is registering as a "common carrier" or a "contract carrier." The historical difference between these two types is reflected in the definitions immediately above. The ICC Termination Act of 1995 defines contract carriage as truck transportation provided under a contract, but, effective January 1, 1996, it no longer distinguishes between common or contract carriers. However, the Act specifically authorizes FMCSA to continue registering applicants as either common or contract carriers. The current principal distinction between the two types is that common carrier applicants must file proof of cargo insurance while contract carrier applicants are not required to do so.
